California Supreme Court Approves Remote Testing for Out-of-State Attorneys.

The California Supreme Court approved significant modifications to the state’s one-day attorney exam, making it more accessible to out-of-state lawyers. This decision introduces new testing options, allowing candidates to choose between taking the exam remotely or at a designated vendor site, offering greater flexibility for busy legal professionals.

Starting with the February 2025 California bar exam, out-of-state attorneys will have the option to take the one-day attorney’s exam either remotely, from the comfort of their own homes or offices, or at a specified vendor location. This change eliminates the need for travel to California, making the exam more convenient and accessible for candidates who previously had to navigate the logistics of flights, hotels, and time away from their practices.

  • Remote Testing: Candidates who opt for remote testing will take the exam via a secure proctoring system, which allows them to sit for the exam in a location of their choice, provided they meet the necessary technical requirements. This includes having a reliable internet connection, a working webcam, and a distraction-free environment. The exam will be monitored through a secure remote platform to ensure exam integrity.
  • Vendor Site Testing: Candidates who prefer to take the exam in a more traditional setting can choose to sit for the exam at an approved vendor site. These sites will provide a controlled environment, complete with technical support. Importantly, candidates who take the exam at a vendor site will be provided with a computer, ensuring that they meet the technical specifications required for the exam. The vendor site will also have an on-site proctor to monitor the exam. Information about specific vendor sites will be made available closer to the exam date.

This dual option gives attorneys greater flexibility in how they approach the exam, allowing them to choose the format that best suits their needs. While the exam format remains the same, candidates choosing remote testing must ensure they meet specific technical and environmental requirements. These include a stable internet connection, a functioning webcam, and a suitable, quiet location free from distractions. Detailed instructions on meeting these requirements will be provided closer to the exam date. Candidates opting for vendor-site testing will be provided with computers.  The vendor sites will also ensure the proper testing environment, helping candidates focus on the exam itself without worrying about technical issues.

Some challenges do exist with the new exam delivery.  Candidates will no longer have access to hard copy exam questions, and scratch paper will be provided virtually. Candidates can use a small whiteboard to take notes or draw diagrams, but no other tools will be permitted.  Out of state applicants should also know that the exam will be administered on Pacific Standard Time only.
